I finalised a Patent Opposition search a week ago. It was successful as I found at least two documents relevant to the granted first claim at least. The claim was awkwardly phrased which made searching a bit more difficult. The AI platform I used found a new document relevant to the concept pretty quickly but the knock out was not present. After talking to the client, it became clear from the Prosecution History the granted claim was narrowed considerably to a particular feature which was not in our new citation. A new document for novelty or inventive step was needed to fill the gap.The AI platform ran out of citations so I used standard CPC and full text strategies.
This was much slower but much more focused too. So AI is really valuable for speeding up searches for concepts and human insight and contextual understanding is still needed. Maybe prosecution files and claim amendments should be included in AI search algorithms.
